How to Trademark a Name
There are two kinds of trademark currently in use. They are the trademark symbol (™) and the registered trademark (®). The trademark symbol is used to resolve conflicts arising out of the use of some marks. Many people therefore register their trademarks to prevent such conflicts. A registered trademark is usually awarded by the Patent and Trademark office. The article below provides information on how to trademark a name but it is advised that a lawyer can definitely help much better in this process.
Let us now have a look at the steps involved in trademark of a name.
- You will have to visit the government website for Patent and Trademark office. There is a lot of information which is provided in the background. Go through them. In order to apply for a registered trademark, you need to provide proof about the first use of the mark in market. It is highly recommended that you use the services of a lawyer while obtaining a registered trademark.
- Search the Trademark Electronic Search System (TESS) and select the new user form search and begin your search.

- The TESS will give back to you a list of trademarks already in use. You will have to notice the status of such trademarks. If you double click on the link, you will receive an information page on the use of that particular trademark word. Remember that trademarks are always industry specific. For example, in case there is a mark which is present in the service industry and you want to use it in the entertainment industry, then it is considered alright. But if there is a mark which is in use in the TV station and you want to use the same mark in a radio station, then it is not permitted.
- Now you can start applying online.
